Xtreme Freight Management offers a warranty to the Customer against loss or damage to Goods during the Carriage, while the Goods are in the possession of Xtreme Freight Management or their agents. Our Warranty is subject to specified limitations and exclusions outlined below.
Warranty Claims:
Customers must make any claim under the Warranty for damage to or loss of Goods via email.
The Customer must notify Xtreme Freight Management in writing of any Claim within the following time limits:
If damage is indicated by the Receiver on the Proof of Delivery or in records within seven (7) business days from the date of delivery.
If the Receiver acknowledges the delivery in good order, within 48 hours from the date of delivery.
In the case of Claims for non-delivery, within seven (7) business days from the expected delivery date.
Each Customer is limited to one (1) Claim per consignment. The Customer must provide proof of the value of the Goods, and if a valid Claim is made, Xtreme Freight Management reserves the right to pay it directly to the Customer’s account by credit note.
Claims will only be processed after the Customer has settled all outstanding amounts on their account.
Warranty Limitations:
Warranty is subject to the following limitations:
Claims cover loss of or damage to the Goods only; consequential loss or damage is not included.
The maximum amount claimable is the lesser of $1,500 or the cost price of the Goods, supported by acceptable documentary evidence.
GST and freight charges are not included in the calculation of payable amounts under the Warranty.
Xtreme Freight Management reserves the right to take possession of goods as salvage after a claim has been paid for damaged goods.
Warranty Exclusions:
Xtreme Freight Management is not liable for Claims in the following circumstances:
If the Warranty charge is unpaid.
If the consignment is on a cash sale basis, and the Customer is not the account holder.
Failure to submit the Claim within specified time limits.
Possession of an unendorsed proof of delivery form by Xtreme Freight Management.
Excluded Goods such as currency, jewellery, precious metals, and others outlined in the terms.
Dangerous Goods not formally accepted in writing by Xtreme Freight Management.
Damage to or loss of second-hand or used goods, with claims paid at the depreciated market value, subject to terms.
Inadequate packaging or labelling of Goods.
Goods determined to be defective prior to Carriage or where damage could not reasonably be attributed to the Carriage.
Force majeure events and other uncontrollable circumstances.
Loss or damage resulting from derailments, collisions, overturning, or delivery to specific addresses.
Amendments to Terms and Conditions:
Xtreme Freight Management reserves the right to amend the contract terms without prior notice to the Customer.
