These terms and conditions govern all services provided by Xtreme Freight Management.

IMPORTANT NOTICE

When you use Xtreme Freight Management services, you agree, representing both yourself and any other party with an interest in the Shipment, that the listed Terms and Conditions shall apply from the moment the Carrier accepts the Shipment, unless otherwise mutually agreed upon in writing by an authorised Xtreme Freight Management officer.

“Shipment” refers to all packages, parcels, pallets, skids or heavy freight under one waybill with Xtreme Freight Management, with invoicing originating from Xtreme Freight Management. “Fleet” refers to vehicles that Xtreme Freight Management utilises for the transportation of shipments. “Xtreme Freight Management” encompasses Xtreme Freight Management Pty Ltd, its affiliates, and any Master Franchise, Licensee, or Franchisee. “You”, “Your”, or “Yourself” denotes your company and your role as an authorised representative.

Xtreme Freight Management Account

You acknowledge being an authorised representative opening an account for your company with Xtreme Freight Management, a non-transportation entity. The information provided in the Xtreme Freight Management Account Application is warranted as true for credit purposes. Xtreme Freight Management may cancel your account at any time, and you agree to pay for all shipments made under the account post-cancellation.

Rates

Xtreme Freight Management rates are exclusive to You, and sharing or reselling to other companies without authorisation is prohibited. Rates are subject to change without notice, and discrepancies in reported Shipment characteristics may alter pricing.

Packaging:

You affirm proper packaging for safe transportation and compliance with fleet requirements and industry standards. Xtreme Freight Management is not liable for damages or injuries claims caused by your packaging due to improper packaging. You confirm the Shipment’s pre-transportation condition and accept liability for concealed damages.

Damage/Defect Packaging

Noted damage or defects in the shipment prior to loading onto our fleet will require you to sign an acknowledgement for these issues. By signing the acknowledgement for damage or defects, you agreed for Xtreme Freight Management to transport the goods as is and cannot hold Xtreme Freight Management or their officers accountable for damages.

Loss or Damage Claims

Xtreme Freight Management is not liable for any damage to goods during transit, loading, and unloading, as well as for loss of profits or indirect and consequential losses resulting from actions by third parties.

Loading and Unloading

The person, people, and the company loading and unloading goods to and from our fleet are required to have proper training and equipment to carry out the task. You, your representative, or the receiver of the shipment are responsible for any damages/injuries caused during loading and unloading including damages to your shipment, other shipments onboard our fleet, damages to our fleet, injuries to yourself, others, and as well as our officers. Make prior arrangements with us if you wish for our assistance in loading and unloading goods onto our fleet.

Insurance

Any shipment warranty product is not insurance, and terms apply as per the Xtreme Freight Management website.

Payment

Payment is due within 7 days from the invoice date. Late Payment penalty of $65+GST for each successive 7-day period in which payment has not been received. This penalty is applied incrementally until the outstanding payment is settled.

Security

Shipments must comply with fleet security requirements, and only goods owned or originating from Your company should be shipped.

Dangerous Goods

Xtreme Freight Management does not manage the transportation of hazardous materials, encompassing, but not limited to, explosives like fireworks or ammunition, gases (flammable, non-flammable, and toxic), and flammable liquids such as petrol or acetone. You must inform both Xtreme Freight Management and our officers if your shipment contains the mentioned hazardous materials or falls under the classification of dangerous goods.

Refunds

Address invoice disputes or refund requests in writing to Xtreme Freight Management within contractual or statutory rights.

Violence and Abuse

Aggressive, confrontational, bullying, racist, harassing, and abusive behaviour is not allowed and will not be tolerated. Xtreme Freight Management may cancel your shipment under these circumstances.

Miscellaneous

The invalidity or unenforceability of any provision shall not affect the other parts of these Terms and Conditions. You acknowledge reading and agreeing to these Xtreme Freight Management Terms and Conditions.
